Terms & Conditions for Pixel Rise Design

These Terms & Conditions govern your use of the Pixel Rise Design website (https://pixelrisedesign.ca) and the services provided by Pixel Rise Design (“we”, “our”, or “us”). By accessing this website or engaging our services, you agree to the following terms:
1. Services
We provide web design services, including, but not limited to:
Website development
Landing page design
Hosting setup support
Ongoing maintenance (if subscribed)
All services are outlined clearly in proposals or service descriptions and are subject to availability.
2. Payments
All prices are in Canadian Dollars (CAD).
A non-refundable deposit is required before work begins.
The remaining balance is due upon project completion or as per agreed milestones.
Payments can be made via PayPal.
Failure to pay on time may delay the delivery of services and/or result in cancellation of the project.
3. Revisions
Most packages include a limited number of revisions (outlined in the service agreement). Additional revisions may incur extra charges.
4. Client Responsibilities
Clients are responsible for:
Providing content (text, images, etc.) in a timely manner
Reviewing work and providing feedback within a reasonable timeframe
Ensuring that any materials submitted do not infringe copyright or intellectual property rights
We are not liable for delays caused by incomplete or delayed input from the client.
5. Intellectual Property
Once the final payment has been received:
You own the final website design and content provided by you.
We retain the right to showcase the project in our portfolio and marketing materials unless otherwise agreed upon in writing.
All pre-designed assets (e.g., themes, plugins, stock images) remain the property of their respective owners.
6. No Guarantees
We do not guarantee specific results (e.g., search engine rankings, traffic, or conversions). While we follow best practices, outcomes depend on many external factors beyond our control.
7. Refund Policy
All payments made to Pixel Rise Design are non-refundable. Please refer to our Refund Policy for full details.
8. Limitation of Liability
Pixel Rise Design is not liable for:
Losses or damages resulting from site downtime, plugin conflicts, or third-party service interruptions
Security breaches on client-managed hosting or platforms
Delays caused by client’s inaction or third parties
In no event shall Pixel Rise Design be liable for any indirect or consequential damages.
9. Privacy
Your use of this site is also governed by our Privacy Policy, which outlines how we collect and use personal information.
10. Termination
We reserve the right to refuse or terminate services at any time, especially in cases of:
Abusive or unprofessional behaviour
Non-payment
Breach of these Terms
If services are terminated by us, any outstanding fees for completed work remain payable.
11. Changes to These Terms
We may update these Terms & Conditions from time to time. Continued use of our services or website after changes indicates your acceptance of the updated terms.
